About This Course

Effective migration advocacy requires more than a thorough understanding of immigration law—it demands the ability to tailor legal strategy to the forum, evidentiary requirements, and applicable standard of review. Whether challenging visa refusals, responding to character cancellations, pursuing judicial review, or seeking ministerial intervention, practitioners must make strategic decisions that maximise the prospects of a successful outcome.

This practical course provides a structured framework for advocacy across Australia's migration decision-making pathway. Participants will explore advocacy techniques for departmental submissions, tribunal proceedings, judicial review, and ministerial intervention while developing practical strategies for presenting evidence, identifying legal issues, and navigating complex migration matters.

Key Topics Discussed:

  • Strategic advocacy across the migration decision pathway
  • Preparing effective submissions to the Department of Home Affairs
  • Advocacy before the Administrative Review Tribunal (ART)
  • Judicial review and identifying jurisdictional error
  • Ministerial intervention pathways and strategic considerations
  • Character cancellations and Ministerial Direction No. 110
  • Evidentiary strategies for migration matters
  • Procedural fairness and decision-maker obligations
  • Advocacy in visa refusal and cancellation cases
  • Common strategic mistakes and practical lessons
  • Managing complex migration litigation
  • Forum-specific advocacy techniques
